Abstract

Discussed is the conflict between hydropower and the environmental coalition, and the probable fate of the Class of '93 dams. Examination of the historical and practical framework of the dam relicensing issue, the history and laws applicable to FERC, and the procedures FERC uses in re-licensing dams. Focus placed on current issues which drive this debate, such as hydropower benefits, fish and wildlife protection, economic development, and increased recreational opportunities. Discussion of the case of the Edwards Dam on the Kennebec River in Maine and the Public Trust Doctrine and its roles as they key to proper river management.
